Notice on the revision of the design creator correction system

Partial Revision to the Enforcement Rule of the Design Protection Act referring to the design creator correction system, effective February 12, 2025. This partial revision applies to design registration applications filed on or after the effective date.

1. Outline of Main Revision

A summary of the revision of the design creator correction system is as follows:

① Restriction of timing for any addition to or correction of registered creators

② Strengthening of procedural requirements (documents to be submitted) for any addition to or correction of registered creators

2. Implications

This partial revision of the Enforcement Rule of the Design Protection Act restricts the addition of a creator/s and only permits corrections when they maintain the identity of the registered creator/s, for the period between when a design registration decision has been rendered until the full registration of the design rights (i.e., the payment of the registration fee). The requirements for submission documents have been strengthened for the period before a registration of design rights is received. The intention is that legal stability will be guaranteed by securing the accuracy of creator information and by preventing the indiscriminate addition or correction of the creator/s.

Therefore, considering that the addition or correction of a design’s creator/s is now limited in terms of time frame, and the requirements for submitted documents are more stringent, this necessitates greater attention to accuracy in designating a creator when submitting an application for design registration.​
